These Terms of Service ("Terms") govern your access to and use of majordesignagency.com (the "Site") and any forms, tools, or interactive features on it, operated by Major Design ("Major Design," "we," "us," or "our"). Descriptions of these Services on the Site are for informational purposes and do not themselves constitute a binding service agreement. Any actual engagement for paid services is governed by a separate agreement (proposal, contract, or invoice) between you and Major Design, which will control over anything stated on the Site in the event of a conflict.
Marketing, advertising, and SEO outcomes depend on many factors outside our control, including platform algorithm changes, market conditions, competition, and your own business operations. Any results, case studies, or figures shown on the Site reflect specific, real outcomes for specific clients at a specific point in time and are not a projection, promise, or guarantee of results for any other business, including yours.
The Site's design, layout, graphics, logo, and original written content are owned by Major Design or licensed to us, and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.
The Site may link to or embed content from third-party platforms (for example, booking widgets, chat widgets, or review platforms). We do not control and are not responsible for the content, policies, or practices of any third-party site or service.
If you opt in to receive text messages or emails from us, you consent to receive those communications as described in our Privacy Policy and A2P Messaging Compliance page. You may opt out of SMS at any time by replying STOP, and out of marketing emails via the unsubscribe link in any email.

TO THE FULLEST EXTENT PERMITTED BY LAW, MAJOR DESIGN AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT EXCLUDABLE, OUR TOTAL AGGREGATE LIABILITY ARISING FROM YOUR USE OF THE SITE ITSELF (AS DISTINCT FROM A SEPARATE PAID SERVICES AGREEMENT) SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
Nothing in these Terms limits liability for a separate, signed services agreement between you and Major Design — that agreement's own terms control for any paid engagement.
You agree to indemnify and hold harmless Major Design and its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or use of the Site shall be resolved exclusively in the state or federal courts located in San Luis Obispo County, California, and you consent to personal jurisdiction there.
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
We may update these Terms from time to time. Changes take effect when posted on this page, with the "Last updated" date revised accordingly. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
